Here is the known order of a 4 car accident, wondering if my son is at fault:
driver 1 - unknown driver crosses over into lane and cuts off my son's friend
driver 2 - my son's friend's car
driver 3 - my son's friend's car
driver 4 - my son's car
in front of driver 1 guy cuts him off so driver 2 hits the brakes, driver 3 hits the brakes and driver 4 hits the brakes. driver 2 did not come in contact with driver 1 until driver 4 hits driver 3, then pushes driver 2 into driver 1.
Anyone who hits the rear of another driver will be considered at fault (in English law) irrespective of the circumstances because they were driving too fast or too close to stop in time.
Hope no-one was injured and that the damage was not too severe!
Yes, being that cars 1 and 2 didnt come in contact with each other until car 4 hit car 3 forcing 3 into 2 and 2 into 1. The law looks at it as car 4 causing the accident even if 1 cut off 2. Car 4 is cited with not paying attention. Had 1 and 2 colided first then situation would be completely different.
Here Car 4 will be considered at fault which was tailgating the car 3 or was driving too fast to bring to halt before it hit car 3. Now since car 3 will be considered at fault for car 2 as it was tailgating Car 2 and Car 2 may not be held responsible if the oficer on field can assess the situation carefully. Rest everything depends on how everyone presnted their version to the officer at the site of accident.
