I was hit in the rear by a drunk driver in Virginia while on vacation. We were spending the last day there with our grandchildren at the beach.One of our granddaughters was hurt with back ain severe whip lash and it did something to her shoulder. The other grandaughter was not hurt that bad, just sore. They did arrest the guy at the scene for drunk driving.I had major back surgery in december of 2008 and it did irritate it some, I had a whip lash, elbow bursed, and shoulder soreness for weeks.I went to the emergency room after the accident and had x-rays done on my back. I have went to my family doctor after returning home and have seen a bone and joint doctor with them taking more x-rays. I was given pain pills and medication for inflamation and muscle relaxers.The doctor wanted me to take phisical therapy but I could not get off work. The damages to my jeep were $2900. My medical expense from emergency room and doctor with the medication is $1916.
My lost wages were about $194. I have to be careful when I turn my head so it does not pop or hurt. It is hard driving and trying to look toward the right.
I will probable see my doctor one more time in a bout 2 weeks. I do not no what to ask for for pain and suffering and the mental stress. I will also have to drive back there to go to court on the other drivers drunk driver trial. Thats 750 miles one way and i will miss 2 days work at about $260 plu gas,hotel, meals and other expenses for the trip.
Whats do you think i should settle for to not be taken advantage of?
