Korlitz was found guilty and ordered to pay Hodesh $775,000.
The jury found the hospital not negligent of malpractice, but not
Dr. Korlitz. The hospital and Hodesh made an high/low agreement
which Korlitz had appealed as collusion that should have been
disclosed to the jury. The hospital sought to limit it's liability
to $250,000, which the court said was okay to do and didnt affect
( lessen in amount) which Korlitz's insurance got nailed for.
The court of appeals however, denied Korlitz's claim of indisclosure
and that 'Mary Carter' did not apply so that Korlitz had to pay in addition
to what the hospital had settled with.
