Package mailed COD (over $500) to one county. Package is picked up and check is received by Post Office and mailed to a different county. Check returned twice for NSF. 10-day demand letter has been issued. Now neither county will issue warrant. My home county says that the Post Office was acting as agent and that is technically where the check was tendered. The county where the post office is located says that warrant must be issued in my home county because that is where I received check. It's a felony and I can't get either county to issue warrant. Need help or guidance!!

your dealing with the normal police. Call the Postal police ,get the number from your local post office. since the crime involved a post office the postal police can tell you what to do.

Make a copy of the check, talk to the District Attorneys (DA) office in your county or city see if they will press charges. If not sue in civil court in many states you may sue for the amount of the check + 2 times the amount of the check. check state law. if the DA will take the case. Wait some time then file the civil suit.

Check your small claims limit. Nolo books has a good book on small claims. most small claim courts have a small claims advisor, Talk to them. read abook or find a semanar on small clains.

A warrant is issued by a court for a criminal action. Writing bad checks is a criminal action. The DA must be the one to prosecute.
