Do I need to register for a Trademark to protect my new product?
Asked by: regimeskates from NEW YORK, NY
I'm going to take a manufactured product such as (floor matting) and use it in a whole new way. I'm taking the raw material and turning it into a new product and putting my name on it.
I'm also a small company with a great idea.
My question is, how do I protect myself from a major corporation stealing and mass producing my product idea before I get the product rolling?

The first thing you need to do is a search. Do both patents and trademarks.
The second thing you need to do is use it. It is first to file, but also first to use. If not used within 5 years, it is invalid.
You can use the patent office site to do your searches. Just click on searches.

Do I need a patent, trademark, or copyright?

One of the most common questions that a newbie inventor has to ask is, "What Do I need? Do I need a patent, trademark, or copyright?" These are the three different types of what is called intellectual property. These are products that come from the creative mind. Intellectual property is imagination made real. Intellectual property is an asset just like your hom...

First, it sounds like you are not really seeking trademark protection. Trademarks are primarily intended to prevent consumer confusion regarding the source of the product. For example, if someone saw your idea (let's call it Bob's Flooring), and made the exact same product, but instead called it Jack's Flooring, then there would be no trademark infringement. So unless some manufacturer out there is trying to use your company name or product name, trademark registration won't offer you any protection.

Trademark is a complicated area of law, and we can't give you all the answers. We can, however, provide you with the procedure for registering your very own federal trademark and explain some of the legal issues around doing so. The lawyers will allow us to do this, and they probably won't bother you, either, unless you infringe on one of their clients' trademarks. Then it's back to the pointy sticks.

first of all dude don't tell people what your doing on this site, geez, and dude I have some pretty darn good stuff myself also, but being a artists contributes to that, it's good to get a small patent company there greedy for new people, they'll give anything to have a new person choose their company over a big corp. they apprieciate that, and acknowledge this and tell them your idea and be thorough, they may be small but they know what they are doing, I don't have any suggestions toward who, but it's good that you hav...
