am i guilty?

copies of 100 dollar bills were found in a trash bag in my room, now, the government is trying to convict me of manufacturing us counterfeit currency. if i plead guilty, i get a lesser sentence. if i take it to trial and i lose, my sentence is 1 or 2 years longer than if i were to plead guilty. what should i do?

depending on what base level i get...if i plead guilty, maybe 12-18 months. if i take it to trial and i lose, i'm looking at 23-56 months. thats according to the sentencing guidelines. the judge may just give me probation, since this is my first offense...i really don't know

I TOLD MY PD THAT I WOULD PLEAD GUILTY TO POSSESSING OR KNOWING ABOUT WHAT HAD GONE ON, BUT SHE WANTS ME PLEAD GUILTY TO THE MANUFACTURING WHICH CARRIES AN ENHANCED SENTENCE. WHAT KIND OF EVIDENCE WOULD THEY NEED IN ORDER TO PROVE ME GUILTY OF MAKING THE COUNTERFEIT MYSELF?

If they are 'trying' to covict you of 'manufacturing' then it is up to them to prove beyond a reasonable doubt that you actually physically made this money with your own hands.....which they would need evidence for ...so... if you think that they have this evidence then the liklihood is that you are guilty anyway and you should take the plea cos its less. However if they happened to come across counterfeit money that happened to be in your room at the time they were also and you think they are trying to scare knowledge ...

First, do everything your lawyer tells you to do. Sounds like you should take the deal, unless your lawyer thinks you can make a better one.

You should know if you're guilty or not. If you go to trial, it will be up to the jury to determine if you're guilty or not.
In your situation, it sounds like you need to get yourself a good lawyer. If this is your first offense and if the amount of bills are small, you should be able to avoid doing jail time. In that case, you're better off agreeing to a plea bargain with the prosecutor to avoid jail time.

Id have to agree with Richard on this one. Especially the part about doing whatever your lawyer says. If you do decide to take it to trial, the gov't will do any and everything to make you out to be worse than you really are-incl. bringing up things about you that you wouldnt want. Thats what happens at a trial-both sides dig deep to find out info-even if it isnt needed.
Id say take the plea bargain, unless you are absolutely NOT GUILTY-and you can prove it. Thats what you need to think about-are you 100% not guilty, ...

Firstly, introspect yourself.. If you or your room partner printed the counterfeit bills or not? If yes, then plead guilty but after consulting your criminal lawyer.

iam sorry but if you are innocent you fight tooth and nail regardless of what lawyers tell you.
