If he was sixteen or under, I think they would have to call the parents. It all depends on what they were questioning him about! If the issue for which he was being questioned was school related, his accuser would be interrogated separately!

However, if your son requested your (his parents) presence or that of any other adult during questioning and was denied such by the police, then there may be a problem.

Individuals questioned by the police are entitled to the presence of an attorney during questioning and on that same token a minor is entitled to have their parent present (if they request it.) As always, a person can always exercise their right to remain silent, regardless of age.

There is no federal law that prohibits police from questioning a minor without their parent(s) or an adult present. Nor is there a federal law requiring a minor's parent be contacted prior to questioning. There may be some states with more restrictive statutes in place but check your local laws to be sure.
