WHAT IF A COLLECTION AGENCY DOESN'T VALIDATE AFTER YOU SEND VALIDATION LETTER
Asked by: ladynbluejeans from -
I RECEIVED A LAW SUIT FROM A COLLECTIN AGENCY. 3 TIMES I REQUESTED A DEPT VALIDATION BUT THE FIRM NEVER DID SEND ME A VALIDATION. EVERY TIME THEY PASS IT TO ANOTHER FIRM AND I GET ANOTHER COLLECTION LETTER AND I REQUEST A VALIDATION AGAIN. CAN I WIN A LAWSUIT SINCE THEY DIDN'T VALIDATE.

Not likely. Unless your debt is really high, they aren't likely to follow through with a lawsuit. Call the collection agency in question, and get your validation that way. Your letters probably ended up in a shredder! Collection agencies use scare tactics, which are perfectly legal, because you do owe the money! They tell you you have to pay the entire debt at one time, but you don't! You can set up a payment plan that is affordable. Good luck!
