Can a person diagnosed with depression/anxiety, be legally deemed as POA?

My brother was diagnosed with depression/anxiety disorder as well as drug addiction. Can he legally over ride a previous POA with his name as acting attorney?
Additional Details added (08/20/08):
In addition. My brother has criminal charges on him for possession of narcotics and intent to sell. He took a copy of a power of attorney for my mother from the internet. He filled this out and conned my mother( who is mentally incapable of understanding , she has Alzheimer's) to sign this poa. Does this make it legal and binding?
