What are our chances of having the children live with us full time?

Hello, below you will find my situation in point form:

- My wife had two kids with her ex...
- Her ex cheated on her and left her for another woman...
- She left with the kids and found out that she was unable to afford to take care of the kids so in their best interest she had to give them back to her ex on the basis that he would give them back to her when she got on her feet.
- Her ex was constantly controlling her through her kids until I came in the picture and set things straight...
- Her ex is constantly on and off welfare due to not being able to hold a job...
- We now take the kids every second weekend in which we drive from Sudbury to North Bay to pick them up on friday night and return them to North Bay on Sunday night...
- We found out that the kids missed a lot of days last year due to her ex not getting up and walking them to school... enough so that the teachers commented on this in the children's report cards.
- We found out that the kids are living with his parents during the week due to him not being able to work and take care of them...
- His parents are already taking care of five other children in a 3 bedroom apartment...
- Her ex is a pot smoker... but doesn't smoke it around the kids...
- Her ex lives in a 3 bedroom apartment and is single
- Her ex has forged her signature on the baby bonus for a couple years (with my wife's permission) but she told him to change it over to his name and he didn't for a couple of years... but when he filed his taxes the government gave him a $6000 cheque due to them thinking that my wife was cashing the cheques and then sent my wife a $6000 bill... He cashed the cheque and spent it... This is another matter that we are taking care of now... all the forms are now legal documents and the legal person who signed said he will be getting into a lot of trouble for the $6000 cheque...

I am not a lawyer and good for me for that. I have had some college law.

Certainly some of the issues you raise would give you good chances. Get a lawyer and petition the court for full time custody. She will have to grant visitation rights. That means the ex will come into your life.a bit more. You do need a lawyer to sort out which issues will convince a judge and how to present them....

all i can say is that you have a good case for the court.
