can marriage considered legal after 10 years separated and both have each own family

Unless you have legally divorced then yes - BY LAW you are still considered married.

I am not a lawyer and good for me for that. I have had some college law.
If you did not get a divorce or an annulment from your previous marriage, you are still married to you first spouse. A separation no matter how long is not a divorce and if you marry someone else, you may be prosecuted for bigamy.
