Power of Attorney
Asked by: sweetntrue from -
My mother just passed away. She did not have a will or power of attorney. My mother and father have been divorced for 43 yrs though resided in the same home. My mother owned half of the home.
I am an only child and my mothers siblings reside in Germany, another world away. They were not close.
My dad before my mom passed, while she was in the hospital started to through out her things and place them in storage. My father has stated he is going to sell the house and move out of the country. I would like to know what it is that I can do as I know my mother's wishes were for my father to not have anything of hers or have anything thrown away. Being it is his house, what are my rights? He has gone to the point of changing all the locks on the house as well so there is no way for me to enter.

Please help - thank you
Micheal

The house may belong to him, but your mother's things belong to you as her next of kin! They were divorced! He is not her next of kin! Don't delay getting a court order to remove her belongings before he disposes of them! Without a will all her property is divided evenly among her children - since you are an only child, you get it all - he has no right to any of it! Move fast, and make sure your mother's wishes are honored!
