LLC or Corporation... BOTH??

Hi there, I'm an AP clerk, and my company uses MANY sub-contractors in the course of business.
I have one vendor who is trying to avoid TAXES... and that has led him to change his company name from an LLC to an INC... Fine, I'll do that, but now he is submitting invoices from the LLC and from the INC... Can he do that????
His W-9 submitted in 2006 lists a NC address with LLC as the designation
His W-9 submitted Jan 2008 lists NV address with INC as the designation
He requests all correspondance and payments made to a CA address.
This guy is FLAT OUT shady, and I don't like it... HELP!

I've been in banking for many years. I can bet that this is not to avoid taxes but something else. With an LLC and an INC they both get seperate tax ID numbers. Kind of like a personal SSN. Look for a Statement of Domestic Stock for INCs! Also, in California, they are required to put both in a newspaper (proof of publication) for 4 weeks and I think it's the same else where.
