Money owed to me
|
I started work in my job in Jan 2007 and was promoted around June 2007. I was told that my basic salary would increase by £4K and this would again increase once I'd proved myself in my new role. However I received no new contract at this point. A few weeks later I asked for proof of earnings in writing to take to my mortgage advisor and was issued a letter on headed company paper, signed by the HR manager stating my new increased basic salary plus 'guaranteed £10K commission'. I did not query this at the time as presumed it formed part of my new contract. However it has now been just over 12 months from the date of this letter and I have seen only a fraction of that amount in commission. 3 weeks ago 20 people including myself have been 'laid off' by the company due to the company failing and overall financial problems. I have had to find myself another job now but would like to know if I have a claim for the remainder of this 'guaranteed £10K commission'? If so, what is the next stage of pursuing this. I don't have any money to pay expensive solicitor fees or court fees.
I am guessing they put this '£10k guaranteed commission' in the letter to help me apply for a mortgage but that was never mentioned/explained to me at the time. Would I still have a case even if they did write it for that reason?

In my opinion, write to the administrators of the company in liquidation, put forward your claim in detail and await their reply before taking further action. Hope you receive what is owed.
