What rights do i have when it comes to keeping my child with me instead of the mother,she has no transport to move the child around,wants to move in with her brother and has no one to look after the child while at work

The courts are not likely to take custody away from the mother, unless she is unable to provide a stable environment for the child. You need documented proof that she cannot provide adequate care for your child, and proof that you are better equiped than she is to be the custodial parent.
