Removal of Personal Possessions
Asked by: bworden from -
My ex-boyfriend has all of his personal possessions in my home. I have asked him numerous times to come and retrieve them and he refuses stating that because I asked him to leave and he has nowhere to put his possessions, he has every right to keep them here for as long as needed. It has been over 4 months and I need his stuff out of here. What can I legally do?

Check your local landlord-tenant code. Even if he is not named on the lease, he is still considered a resident. You might even have to go so far as to serve him with an official eviction notice (and provide proof of service) as well even though he hasn't been there for 4 months.

He does NOT have the right to keep his property there "as long as needed" but he would still have some rights under the landlord-tenant cod...
