How to handle a personal dispute over refund of rental?
Asked by: A380 from Singapore, Singapore
I had sublet out a flat through an agent to 3 students from China. But the flat owner had withdrawn from renting to me as I had oversght of the students' documents and trusted the agent will assist me to check their documents.Only after they had shifted in,I discovered they are only 18 years old and the eligible age to sign a tenancy agreement should be at least 21 years old and above. As she had already paid me 6 months rental to me and I had used the money to pay for my father's medical bills who is now at the advanced stage of stomach cancer and therefore I am unable to refund the full amount. These China students had hostel to stay which provided by the Institute which they had enrolled but they chose to stay out as they wanted to have some privacy of their own.Initially,I had put them to stay in a hotel thinking they will inform the school and arranged for hostel which I had already spoken to the school manager and she had also told me that the school will arrange for them but the school can't force them to do so if they choose not to.This issue had already dragged for a month and out of guilty and sympathy plus a police report had been made and statement given but the amount reported had differ from what she demanded from me,1 of them who claimed of her weathly family had demanded from me the hotel charges which had accumulated to S$1900 to date that could even cover a month rental for a house.I had paid her back $1000 as rental refund that made a total of $2300.I was told by the police officer that I just got to pay her the amount I had owed her but she felt that I had disrupted her from renting a flat as she wanted to live a better environment and also wanted to have a room by herself plus she needed a companion whom she invited to stay with her without charging her also wanted to have a room alone.i,m threatened by her calls and sms which had became threatening by using underground society or approach my mother since my father was unwell.I need advice urgently

I am not a lawyer and good for me for that. I am a landlord.

It sounds like you have made a very expensive mistake. This could easily cost you a great deal more. I would borrow or sell something to get these people their money back. You want to get out from under this obligation.

First mistake! Not checking the ages of the students! You did the subletting, and that was your responsibility! Since it is illegal to rent to people under 21, you have to pick up the tab since you spent the six month's rental. Because the rental was not available for rent during this period because of your actions, you are also responsible for the landlord's loss of income! Pay the bill and save yourself a lot of grief! It's a lose-lose situation for you! Wish I had better news, but the facts are what they are!...
