Legal separation , mother in nursing home

My mom suffered a stroke and is in a nursing home, married for 10 years and her husband is living in matrimonial family home. My question is , can the family get a legal seperation between them? The reason is he has had his children move in and they are selling my mom's belongings . 99% of the belongings in the home belong to my mom and my deceased father.

The disposition of this matter rests largely on whether or not your mother has assigned power of attorney over her affairs. If not, and she has not made her intentions clear regarding her property, then her husband most likely is within his rights as a spouse. If your mother is incapacitated, you may petition the courts to become a legal guardian of her affairs, and thus gain control over her estate.
