Can dad take my daughter?

My daughter's father is threatening to take her away from me, because I keep asking him to make maintenance payments. The last payment was January 2008.

If you have a court order for the support, he is making an empty threat. In fact it more likely that he will lose some rights. If it should happen that he has a very good lawyer and you do not, that could be bad for you.

If he tries to take your daughter, he won't succeed! But he may end up getting his wages garnished if he tries! No judge will take a child away from the mother unless she's unfit - by that I mean, abusive, drug or alcohol addicted, unsuitable living arrangements, unable to take care of the child's needs finanicially physically and emotionally. If he attempts to take your child, you can have him charged with kidnapping! That carries a long prison term! I think his threats are empty! He's trying to get out of paying child...

This is solely my opinion but i think you can actually sue him if it's on your agreement that he has to pay but he can still take the daughter unless you can prove that he wants to take her so he won't have to pay!

is a maintenance payment similar to an alimony payment in the U.S.? If it is, why does he not want to make the payments? It is his legal moral responsibility to make the payments. He helped bring the child into the world, right?
