dying intestate

My father has died leaving no will he has no partner as he was divorced from my mother 20 years ago we have been told that under scottish law myself and my two brothers will inherit his whole estate my question is that if he has named benefactors to his pension and or life assurance other than ourselves will we have any claim on these policies

No! But as far as his estate is concerned, it will go to probate, and the balance will be awarded to you and your brothers. You can contest the fact that he named benefactors for his pension and life insurance, but you are unlikely to win that case!
