If I have a tree that hangs into my yard from my neighbors yard, can I cut it?

I want to cut a tree that hangs into my yard from my neighbors yard and want to make sure he can't sue me or take me to court for cutting it.

If it's just a branch that's in your yard that shouldn't be a big deal and you could cut what hangs over the property line
However if you want the whole tree gone you'd have to clear it with him.
i advise you talk to him about it regardless of what you want to do with he, he might even help.

I would also say only the limbs hanging on your side without permission.
