Asked by: samijo512 from -
If i decided to drop the charges against somebody for stealing my computer, do I have to fill out a written statement with the police? I dropped the charges, I don't think it is necessary for me to have to fulfill a written statement. Please someone help my question soon.

When you drop charges after they have been filed, you have to sign a legal document which states that this person did not steal your computer. Then the charge will be dropped legally. Otherwise, the authorities can proceed with an indictment on this charge. You must state that you were mistaken about this theft, or you can be charged with purgery.

In some jurisdictions (as is the case in mine) once the case is filed with the Prosecuting Attorney's office the option to prosecute no longer lies with the "victim." In order for the case to be "dropped" the victim must explain why they feel criminal charges should not be filed against the defendant and do so in writing to the satisfaction of the Prosecuting Attorney.
