How do I get my money back?

My husband and I lent a "friend" a large sum of money ($100,000), with only an oral contract binding us. He is now avoiding us at all costs, and seems to be MIA at the moment. We are unsure as to what to do at this point, and would like to pursue this legally. Can you give us any advice?

Gather as much documentation regarding the alleged loan as you possibly can. Write down as much information as you can recall in a journal. Include dates, times, etc. Hopefully, you didn't give him the money in cash. If you gave him a check, then there would be a record of him cashing or depositing it. A Currency Transaction Record was no doubt filed by the bank with the IRS (if this occurred in the U.S.) because of the amount. Consult an attorney as soon as possible and take your "friend" to court. Good luck!...

I am unsure of how binding an oral agreement is, in this case. I think you should see a lawyer about this. Best of luck...
