Damage to car by automated car wash equipment

I drove into my neighborhood drive through automated car wash when it said drive forward ,I did. When it said stop, I did. When it started washing my car the arm hit my front fender and started scratching and mangling my car. The owner said he was not liable, because he said I did not line the car up correctly. I find that hard to believe since I have been washing it there for years, I said he was liable because he did not have a "fail safe" on the equipment that should have shut it down as soon as it touched my vehicle. If he has a general "not responsible for damage" sign up, is he still liable for equipment failure? The car wash ins estimator met me at the car wash and looked everything over and is to get back with me, but I expect them to deny my claim. I am fighting mad and need any help I can get.

I had that happen to me so we are both mad because they denied my claim. This was some time ago. I considered my options and figured out that it would cost more to pursue it than I would get. So we are stuck. Join the crowd. It is not a happy bunch.

I saw one like this on Judge Judy (yes, I DO watch the show!) and she ruled for the car owner. BUT it was a automatic wash that pulled the car through the booth. The wash owner said he had up signs that said he had no liability, but Judge Judy said he did.

You never know... take it to small claims. The judge there may have had the same thing happen to them!

Car Washes are notorious for "blaming the victim".

They often have written disclaimers posted somewhere within the perimeter of their property. Some even sell you a ticket which reads " We accept no responsibility for the internal or external condition of you vehicle". If you use the ticket to go through you've accepted the terms of the contract.
