Can I be demoted or reclassified if I am an Independend Contractor?
Asked by: dinsurer from -
Im connected with this insurance company for about four years as an Agency Manager. Last year, I was not able to deliver the required production qouta and this year they write me a letter informing me that they are reclassifying me to one leverl lower and therefore preventing me to get all my future commissions. We have no employee employer relationship but they require me to attend meetings, meet qoutas, etc. When they demoted me, they also transfer some of my associates to another agency without my permission. Please advise me what to do, should I refer this case to our labor department?

You absolutely should. This sounds like a clear violation of IRS rules. They will owe you benefits, part of your tax payments, etc. You could report them to the IRS. You might get a big reward.
